NEW YORK (Reuters) -E. Jean Carroll returned to the witness stand on Monday where a lawyer for Donald Trump sought to disprove her claim the former U.S. president raped her, after the judge denied a defense request for a mistrial.
Trump's lawyer Joe Tacopina resumed cross-examination of Carroll about five hours after requesting a mistrial in her rape and defamation civil case, saying the judge made several "unfair and prejudicial" rulings.
In an 18-page letter filed early on Monday in Manhattan federal court, Tacopina accused U.S. District Judge Lewis Kaplan of bias against the former U.S. president, including in the jury's presence.
He said the effect of Kaplan's rulings "manifests a deeper leaning towards one party over another," including in comments where the judge "openly expresses favoritism."
The judge denied the motion for a mistrial before testimony resumed.
Requests for mistrials are often long shots, including when they are based on the judge's own statements. Such requests also often form a basis for eventual appeals.
Trump is leading the Republican field in the 2024 presidential race. Kaplan was appointed to the bench by Democratic President Bill Clinton.
A businessman-turned-politician, Trump has not been attending Carroll's trial, and on Monday was in Scotland for a short trip to visit his golf courses there, and eventually in Ireland.
Carroll, 79, has accused Trump, 76, of raping her in a Bergdorf Goodman department store dressing room in late 1995 or early 1996, and then undermining her credibility and career by lying about it online.
The former Elle magazine advice columnist's defamation claim concerns an October 2022 post on Trump's Truth Social platform, where Trump called Carroll's case a "complete con job" and "a Hoax and a lie."
Trump has consistently denied that the rape happened.
Because the case is civil, Carroll must establish her claims by a preponderance of the evidence, meaning more likely than not, and need not meet the tougher criminal standard of proof beyond a reasonable doubt.
Tacopina said Kaplan should have let him question Carroll about why she did not seek security camera footage of the alleged rape, and why she did not tell police.
He also challenged Kaplan's handling outside jurors' presence of a Twitter post by Trump's son Eric discussing how LinkedIn co-founder Reid Hoffman was helping fund her case.
Tacopina called Eric Trump's tweet protected speech, and objected to Kaplan saying the tweet might leave Donald Trump "sailing in harm's way" and that "some relevant United States statutes" might be implicated.
Others who may testify for Carroll include two friends with whom she spoke shortly after the alleged rape, and two other women who have said Trump assaulted them.
Several women have accused Trump of sexual misconduct. He has denied their allegations.

* Russia hurled missiles at cities across Ukraine early on Friday as people slept, killing at least 25 civilians in the first large-scale air strikes in nearly two months, as Kyiv said it was nearly ready to launch a huge assault to retake occupied land.

British army’s new Ajax fighting vehicle will not be ready until end of decade

Atroubled £5.5bn programme which is already six years late in building the British army’s new Ajax fighting vehicle won’t be delivered until the end of the decade.
Labour accused the government of failing British taxpayers and troops after the Ministry of Defence confirmed that payments towards vehicles will resume after ministers concluded the programme is “turning a corner”.
Originally intended to enter service in 2017, the programme has been repeatedly delayed, with problems including noise and vibration issues that have injured soldiers testing the vehicles.
After halting payments to General Dynamics Land Systems UK (GDLS-UK) more than two years ago, the MoD said on Monday that it would hand over £480mthis month to the arms company. It said that full operating capability is expected between October 2028 and September 2029, when the army has trained and converted forces to the new vehicle.
Defence procurement minister, Alex Chalk, said in a written statement to MPs that payments would resume with a payment of around half of what has been held back since December 2020.
“Restarting payments to General Dynamics reflects the fact that the programme continues to return to a firm footing and supports the delivery of the schedule to deliver operational capability,” he added.
He said further payments for 589 of the fighting vehicles will be made against a “new schedule and its milestones”.
“The Ajax programme is turning a corner, but this does not remove the need for the department to identify and learn lessons,” he added.
However, John Healey, Labour’s shadow defence secretary, accused the Conservatives of spending billions more on a project which is already six years late and won’t fully deliver until the end of this decade.
“The defence secretary has made Ajax central to the future of the army and the UK’s ability to fulfil our Nato obligations, yet after 13 years and £4bn investment the army has still not got a single deployable vehicle,” he added.
“It is clear the government can’t deliver value for public money or the equipment our forces need to fight. Ministers are failing British taxpayers and British troops.”
The public spending watchdog said earlier this month that the army had been left with ageing armoured vehicles that were expensive to maintain as a result of delays which meant that the MoD had received only 26 vehicles as of December 2021 after paying £3.2bn. The National Audit Office said the MoD and GDLS-UK’s approach was flawed from the start and they did not fully understand the scale or complexity of the Ajax programme.
Action to overcome problems now includes modifications to better isolate the human body through measures including cushioning and the introduction a layered approach to ear protection which includes inner ear pieces so troops can communicate and outer ear protection.
Some 589 Ajax vehicles, assembled predominantly at General Dynamics in Merthyr Tydfil, are due to be delivered to the British army. The whole programme remains within its originally approved budget level, according to the MoD.

WASHINGTON (Reuters) - The United States has resumed surveillance drone flights over the Black Sea region following a Russian fighter jet intercept on Tuesday that led to the downing of a U.S surveillance drone, two U.S. officials said on Friday.
An RQ-4 Global Hawk flew a mission to the region on Friday, the officials said, with one adding that it was the first such drone flight since the Tuesday incident. Pentagon officials have repeatedly stressed this week the incident would not stop Washington from flying such missions.
Still, the downing of a U.S. MQ-9 drone on Tuesday was the first direct U.S.-Russian incident since the Ukraine war began, worsening already tense relations between Washington and Moscow as both countries publicly traded blame.
Russia has denied U.S. accusations that its two Su-24 fighter jets acted recklessly around the unmanned U.S. aircraft, and instead has blamed "sharp maneuvering" by the drone for the crash.
However, the Pentagon released a video on Thursday showing a Russian Su-27 fighter jet coming very close to the drone and dumping fuel near it, in what U.S. officials said was an apparent effort to damage the American aircraft as it flew.
It also showed the loss of the video feed after another close Russian maneuver, which the Pentagon said resulted from a Russian jet colliding with the drone.
The video ends with images of the drone's damaged propeller, which the Pentagon said was caused by the collision, making the aircraft inoperable and leading it to crash into deep waters.
The incident over international waters was a reminder of the risk of direct confrontation between the United States and Russia over Ukraine, which Moscow invaded more than a year ago and which Western allies have supported with intelligence and weapons.
